These terms govern your access to and use of cairnstreecare.com.au (the "Service"), operated by Cairns Tree Care ("we", "us", "our"). By using the Service you agree to them. If you do not agree, do not use the Service.
What this site is
This is a referral website. Cairns Tree Care publishes information about tree work in Far North Queensland and passes enquiries to independent tree contractors. We are not the party that carries out tree work, and submitting an enquiry does not create a contract for tree services between you and us.
Any agreement for work — its scope, price, timing, warranty, insurance and liability — is between you and the contractor who quotes and performs it. You are responsible for satisfying yourself as to that contractor's licensing, qualifications, insurance and suitability before work starts. See the Disclaimer for more on this.
Using the Service
You agree to use the Service lawfully and not to interfere with it, attempt to gain unauthorised access to it, scrape or harvest it by automated means, transmit malicious code, or use it to send unsolicited communications. You agree that any information you submit through an enquiry form is accurate and that you are entitled to provide it, including the address of the property concerned.
Information is general
Content on this site — including material about species, pruning, storm preparation, council rules and costs — is general information about how tree work usually runs in this region. It is not a site-specific arborist's assessment, not legal advice, and not a substitute for checking the current requirements of Cairns Regional Council or any other authority for your particular property. Rules, planning schemes and legislation change. Verify anything you intend to rely on.
Quotes and pricing
No price is published on this site and nothing on it constitutes an offer to perform work at a particular price. Prices are given by contractors following an on-site assessment and are subject to their own terms. The cost guide describes factors that affect pricing generally and is not a quotation.
Intellectual property
The content, layout, text and images of this site are owned by or licensed to Cairns Tree Care and are protected by copyright. You may view and print pages for your own personal use. You may not reproduce, republish or commercially exploit any part of the site without written permission.
Links to other sites
The Service may link to third-party websites, including council and government resources. We do not control those sites, are not responsible for their content, availability, terms or privacy practices, and a link is not an endorsement. Review the terms and privacy policies of any site you visit.
Limitation of liability
To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, and we exclude liability for any loss or damage arising from your use of, or inability to use, the Service or from reliance on its content, including work performed by any contractor introduced through it.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, that cannot lawfully be excluded. Where liability can be limited rather than excluded, it is limited to resupplying the relevant service or paying the cost of having it resupplied.
Privacy
Personal information submitted through the Service is handled in accordance with our Privacy Policy.
Changes and severability
We may modify these terms at any time, and the current version always sits on this page. Continuing to use the Service after a change means you accept the revised terms. If any provision is held invalid or unenforceable, the remaining provisions continue in effect. A failure to enforce a right is not a waiver of it.
Governing law
These terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
